Default Class Action Law Suit with gas engines up to 30HP

I just received a post card today about a class action lawsuit concerning lawn mowers with gas engines in them up to 30HP. If you purchased a lawn mower between January 1, 1994 and April 12, 2010 you can submit a claim form. Looks to me like the list of lawn mowers, (walk-behind and tractors), and the defendants, includes just about every manufacturer. The lawsuit claims that the Defendants misrepresented and overstated the horsepower of their lawn mowers and lawn mower engines. Anyone else get this notification? Are you going to file a claim? I have a couple of machines that I think will fall in that category but I don't know if I'm going to file a claim. The card states that the settlements provide a variety of benefits, (I think some are giving extended warranties), including cash payments (up to $35 for a walk-behind mower/ up to $75 for a riding mower). Great. You get $75 and the lawyer filing the suit get $75 miilion for his troubles correcting the 0.2 HP wrong down to all of us.

Meanwhile, Briggs and Kohler cut domestic production to cover their losses, and ship even more manufacturing off-shore.

I get $75 and some poor cheesehead goes on unemployment.

Refuse to be included in the lawsuit if you get a card. It serves no purpose.

Ken - yes that is the same one. I did a search for it on here before I posted mine to see if anyone else had posted something on this. I didn't get any threads that was about this lawsuit so I posted mine.
D-Dogg - I was thinking about the same things you are. The only one's going to gain anything from this is the lawyers! Probably some big $$$$. I'm not going to file a claim.

Who gives a rats a$$!! If you have read anything here at all, it's not the horsepower that gets the job done !!

We're of the same mind. Class action lawsuits are such a waste... end consumer gets nothing or next-to-nothing, mfr's get headaches and losses, and lawyers get fat paychecks.

they been trying to do this suit for 5-6 years now. i know i bough tmy Bolens push mower in 2005 and the suit was going on then. IF any plaintiffs do get money from it, it will be years more before it happens. and even then it may be enough to buy a couple cokes.

Many years ago, I thought lawyers should be allowed to advertise, now they can and what a mess. "IF you or anyone you know or might have known MAY have sneezed as a result of -----call and let us sue someone"

this is against kohlers also??? BTW in advance I still won't participate. mt 18 k magnum will easily throw wads of turf with the ag tires at part throttle. doubt they overstated its output

I see it this way.. You been using that machine for how long and never traded it off.... Can YOU tell the difference between 5.5 hp and 5.75hp??

I agree, Ulimately only the Lawyers are winning out of this suit. Now if the manufactures or Lawyers would send you the MISSING Hp, free of charge THEN, I jump on the junk wagon.

What do you bet this is why the newest mowers don't list the HP on their hoods?
Like you need 30hp to run a 2 blade 42" deck anyway.

good point. I remember the highest hp available used to be 20, not there are 23hp etc, and the machines are much lighter in weight also. not to mention the decks don't cover a very large area
