I just found out that Ohio has a tax form you can file for getting back taxes that were illegally paid.
Charging road tax on fuel being used of road is an illegally paid tax.

This being the case there is no reason for anybody in OHIO using fuel off road to pay the higher on road fuel prices.

Too bad I don't off road enough, however fuel for my power tools (Becky) should qualify for being exempt I would think. IF I had saved receipts...

But they get away with it because people wont mess with it... its hassle. We dont use enough gas around here to mess with, and obviously burn offroad diesel in everything but the semi...

Are things the same for farmers today as when I grew up? The fuel that was delivered to the farm came without the road tax included?

offroad diesel is dyed red, has higher sulfur content than on road diesel which is green in color and has low sulfur.. only road diesel has a tax...

I assume you can get gas delivered to the farm without tax if you had a gas burner around...it isnt dyed so what you do with it then is your own choice, I assume

A guy I work with (the DOG) looked into getting gas delivered right to his house, but was told he had to get 1500 gal. a year....he said 'I don't think so'.... ROF

So does diesel used off the road - I've never used diesel on the road just off the road only but I've paid road tax on every gallon of it.

If you buy at SelfServe Convience pumps theres a road tax added..Only place around here to buy Nontaxed fuel(farm) is at Grain ,seed , elevator.. or have it delivered to your tank in bulk....Br, :trink40:

Did he check with more than one supplier/dealer? There are a lot of small farms around here, and I know of 1 person getting gas delivered to their house (no farm), no minimum purchase. I know they can't be using 1500 gallons a year. Some of them only have a 75 gallon storage tank.

If the fuel is used on the road pay the tax.
If it's not then you shouldn't pay the tax.

It's as simple as that so why do they make it so complicated ?

I don't know. He called that place at lunch...while in the shop. I heard him say "OK...thanks", and then hang up....then he told me what 'they' and 'he' said....he finished the conversation with "The he11 with that"....and left the shop. (lunch was over)

Why am i being charged a road use tax on fuel I'm not using on the road?
